How a DUI Charge Becomes a Felony
Your DUI offense can be escalated from a misdemeanor for a felony under a number of circumstances. For the most part, the escalation occurs if your alleged behavior endangered someone else.
There are three main ways a DUI charge can be escalated to a felony in Georgia:
- Serious injury: If you are arrested for a DUI after causing or being involved in a car accident that results in a serious injury, then you are likely to be charged with a felony DUI. A serious injury is defined in several ways but typically describes an injury that causes immediate and likely-permanent harm.
- Death: Being involved in a car accident that causes the death of another person will constitute a felony DUI and possible vehicular manslaughter charges. A conviction could result in up to 15 years imprisonment.
- Repeat convictions: You can also be charged for a felony DUI even if you did not hurt anyone and completely cooperated during your arrest. This happens if you already have other DUI convictions on your criminal record. Georgia keeps DUI convictions on your record for 10 years, and the fourth DUI will trigger a felony charge.
